1. Agreement to Terms

By accessing or using Purple Crayon ("Purple Crayon", "Service", "we", "us", or "our"), a product of Coda Tech LLC, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

2. Description of Service

Purple Crayon is a mobile application that:

  • Scans children's drawings and converts them into 3D characters
  • Animates 3D characters with various dance moves and actions
  • Places animated characters in augmented reality environments
  • Records and exports AR videos for sharing

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Account and Usage

A. Age Requirement

Purple Crayon is designed for family use. Users must be at least 13 years old to create an account. Children under 13 may use the app under parental supervision.

B. Content You Create

You retain all rights to your drawings, generated 3D models, and recorded videos. By using the Service, you grant us a limited license to process your drawings solely for the purpose of generating 3D characters.

4. Subscriptions and Billing

A. Free Tier

Purple Crayon offers a free tier with limited monthly scans. No payment information is required for the free tier.

B. Premium Features

Premium subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions. We do not collect or store your credit card details.

C. Automatic Renewal and Cancellation

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Manage or cancel your subscription through your Apple ID Account Settings.

5. Acceptable Use

You agree to use Purple Crayon only for lawful purposes. You agree not to:

  • Use the Service to process inappropriate or harmful content
  • Attempt to reverse-engineer the 3D generation technology
  • Use the Service for commercial purposes without authorization
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service

6. Intellectual Property

All intellectual property rights in the Service (including software, AI models, animation assets, and the "Purple Crayon" name) are owned by Coda Tech LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service on your personal device.

7. AI and Generated Content

Purple Crayon uses artificial intelligence to generate 3D models from drawings. You acknowledge that:

  • AI-generated results may vary in quality and accuracy
  • Not all drawings will produce optimal 3D characters
  • We continuously improve our AI but do not guarantee specific results
  • Generated 3D models are derivative works based on your original drawing

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Coda Tech LLC be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Coda Tech LLC from any claims arising from your use of the Service or violation of these Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Indiana, without regard to its conflict of law principles.

11. Dispute Resolution

Any disputes shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the commercial rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the new Terms.
